A Grant of Probate is a court order issued when the deceased left a valid will, confirming the will's validity and authorising the named Executor to administer the estate.
A Letter of Administration is issued when there is no will — it appoints an Administrator, typically the next of kin, to manage and distribute the estate according to the Intestate Succession Act. Both serve the same essential purpose: giving the appointed person the legal authority to access and distribute the deceased's assets.
Without either of these court orders, the appointed Executor or Administrator has no legal authority to access the deceased's bank accounts, insurance policies, CPF nominations, or property — regardless of what the will states or how close the family relationship is. Financial institutions and government agencies require this court order before releasing any assets. Obtaining it is a necessary legal step that protects both the estate and the beneficiaries.
The timeline varies depending on the complexity of the estate and whether a will exists. A straightforward Grant of Probate typically takes between two to four months from the point of application. A Letter of Administration may take longer if the estate is complex or if there are disputes among family members.
